Agreement to Terms

By downloading, installing, or using Meeting Mind ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

1. License Grant

Meeting Mind is licensed to you through the Apple Mac App Store. Your use of the App is governed by Apple's Licensed Application End User License Agreement (EULA), which is incorporated into these Terms by reference.

Subject to your compliance with these Terms, Kilabyte IO grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal or internal business purposes.

2. User Responsibilities

Recording Consent: You are solely responsible for ensuring that you have the legal right to record any meeting, conversation, or audio that you capture using the App. You must:

• Inform all participants before recording any meeting or conversation
• Obtain all necessary consents and authorizations required by applicable laws
• Comply with all federal, state, local, and international laws regarding audio recording
• Understand and comply with two-party consent laws where applicable

You acknowledge that: Recording laws vary by jurisdiction, and it is your responsibility to understand and comply with all applicable laws. Kilabyte IO provides the App as a tool, but does not provide legal advice regarding when or how you may record meetings or conversations.

3. Prohibited Uses

You agree not to use the App to:

• Record any meeting or conversation without proper disclosure and consent
• Violate any applicable laws or regulations
• Infringe upon the privacy rights of others
• Engage in any illegal, fraudulent, or harmful activities
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices

4. Privacy and Data Processing

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your data. Key points:

• All processing happens locally on your Mac by default
• We do not collect, store, or access your meeting recordings or transcriptions
• Optional cloud AI services (OpenRouter) are governed by their respective privacy policies
• You retain complete control over all recordings and data

5. Free Tier and Pro License

Free Tier: The App includes a free tier that allows up to 60 minutes of recording per day. This free tier is provided "as is" with no warranty or guarantee of continued availability.

Pro License: Unlimited recording requires a one-time purchase through the Mac App Store. This purchase is managed entirely by Apple and is subject to Apple's refund policies.

6. Refunds and Purchases

All purchases are processed through the Apple Mac App Store. Refund requests must be submitted directly to Apple according to their refund policy. Kilabyte IO does not process payments or refunds directly.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Kilabyte IO does not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KILABYTE IO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use of or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code that may be transmitted to or through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content
• Your violation of any recording laws or failure to obtain proper consent

9. Indemnification

You agree to indemnify, defend, and hold harmless Kilabyte IO and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

• Your use of and access to the App
• Your violation of any term of these Terms
• Your violation of any third-party rights, including without limitation any privacy or recording consent rights
• Any recordings you make without proper consent or authorization

10. Third-Party Services

The App may integrate with third-party services (such as OpenRouter for AI processing). Your use of these services is subject to their respective terms of service and privacy policies. Kilabyte IO is not responsible for any third-party services or their content.

11. Modifications to Terms

Kilabyte IO reserves the right to modify or replace these Terms at any time. If a revision is material, we will provide notice by updating the "Last updated" date at the top of this page. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.

12. Termination

Kilabyte IO may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
